Foggy Nelson’s fate in ‘Daredevil: Born Again‘ has been haunting fans ever since that brutal premiere moment. Many have refused to accept what they saw and clung to theories that he might still be alive somewhere in Fisk’s growing empire.
Now, Charlie Cox has finally addressed those theories. He revealed that, behind the scenes, the makers were planning a version in which Foggy stayed alive.
How A Scrapped Twist Could Have Kept Foggy Alive In ‘Daredevil: Born Again’

Charlie Cox opened up about this alternate Daredevil direction while appearing on Entertainment Weekly’s Debunked series, where he reacted to fan theories about the show. One popular idea suggested that Foggy might not be dead at all, but secretly imprisoned in one of Fisk’s hidden cages.
Instead of dismissing it outright, Cox admitted the theory had some truth behind it. “So I’ll tell you what’s impressive about that,” he said during the interview. “I remember there was a moment where they discussed the possibility of that being the case.”

The idea remains directly connected to Fisk’s major storyline in the series. As mayor, he builds a secret anti-vigilante task force that locks away enemies and dissidents in cages who are operating outside legal systems. Within that framework, the writers imagined a twist in which Foggy would be revealed to be alive.
Cox explained that in that version, “at the end of season 1, you saw Foggy in a cage.” It would have completely changed the emotional angle of the finale and set up a very different direction for season 2.
Why They Ultimately Chose A Darker Path

Despite seriously considering that twist, the creators eventually decided to take a more grounded approach. Cox made it clear that the idea didn’t survive because it didn’t feel realistic enough for the tone they were aiming for.
“Sadly, that was not the case,” he said, adding that the show tries to stay as believable as possible. That commitment pushed the team toward a more final and impactful decision. And that decision plays out brutally on screen. Foggy discovers key details about Fisk’s illegal operations tied to Red Hook Port. It’s a location outside federal and municipal control. That knowledge makes him a target.

Vanessa Fisk also takes action by releasing Bullseye, who carries out the hit. In the opening of the season 1 premiere, Bullseye shoots Foggy in the chest outside the team’s bar and kills him in a moment. That shocks both the characters and the audience.
The decision was not lost on the creators. Marvel Television head Brad Winderbaum admitted, “The death of Foggy was something that we really agonized over.” He compared it to Gambit’s death in X-Men ’97, explaining that characters like Foggy are essential to the story’s core. And losing them changes the entire world of the show.
Cox also spoke for the fans who are still holding on to hope. “I understand the desperate need, the clutching at straws to convince us that he’s still alive,” he said. Reacting to another theory, he added, “I hear the anguish in this person’s text.” However, Cox and Vincent D’Onofrio didn’t leave much room for doubt. And, they repeatedly emphasized one thing: “Foggy’s dead.”
D’Onofrio added his own perspective, saying, “I would just like to say, and this is not a lie, that I am happy I wasn’t the one who killed Foggy,” subtly acknowledging the emotional impact of the storyline.
Still, there’s one detail that keeps fans guessing. Elden Henson is confirmed to return in season 2, which premieres March 24 on Disney+. Marvel hasn’t revealed how he will appear, leaving just enough mystery for theories to continue.
