    Stephen Wilson, a U.S. District Judge, issued a ruling in a deceptive movie trailer case involving the 2019 flick ‘Yesterday.’ The film follows a scenario where no one has heard the songs of The Beatles.

    According to Variety, the judge ruled on Tuesday that a film studio can be sued under false advertising laws if they release manipulative and deceptive trailers of their films.

    In January, two fans of Ana De Armas filed a lawsuit after they rented ‘Yesterday‘; Armas was featured in the trailer. However, the actress was removed from the final film. Universal, the studio behind the film, tried to throw the lawsuit by stating that trailers have freedom of broad protection under the First Amendment.

    Their lawyers said that a trailer is an “artistic, expressive work” and should only be considered “non-commercial” speech.

    Wilson rejected the studio’s argument by stating that a trailer is subject to the California False Adverting Law and the state’s Unfair Competition Law.

    Universal is correct that trailers involve some creativity and editorial discretion, but this creativity does not outweigh the commercial nature of a trailer,” the judge ruled.

    They continued, “At its core, a trailer is an advertisement designed to sell a movie by providing consumers with a preview of the movie.” De Armas was initially supposed to play the love interest of the film’s lead. According to its writer, her role was cut because audiences didn’t like the idea of the lead moving away from his main love interest.
