It has been almost a year since the director of photography of ‘Rust‘ Haylna Hutchins was killed by a live round fired from a prop gun on the set of Alec Baldwin’s Western flick.

According to Variety, her estate has come to a settlement with the film production and the shooting will also resume in January. The incident also injured film director Joel Souza.

We have reached a settlement, subject to court approval, for our wrongful death case against the producers of ‘Rust,’ including Alec Baldwin and Rust Movie Productions, LLC. As part of that settlement, our case will be dismissed,” Matthew Hutchins, husband of the late Halyna, said.

Hutchins will serve as an executive producer on the film, which will resume “with all the original principal players on board in January 2023” as part of the settlement. “I have no interest in engaging in recriminations or attribution of blame (to the producers or Mr. Baldwin),” Hutchins said. “All of us believe Halyna’s death was a terrible accident. I am grateful that the producers and the entertainment community have come together to pay tribute to Halyna’s final work.”

In August, the FBI’s forensic analysis and the New Mexico medical investigator’s report on the case were concluded. They were turned over to the sheriff’s office.

The report concludes that Hutchins’ death was caused by a gunshot wound to the chest by Alec Baldwin. It also said that a “review of available law enforcement reports showed no compelling demonstration that the firearm was intentionally loaded with live ammunition on set.”

Based on all available information, including the absence of obvious intent to cause harm or death, the manner of death is best classified as accident,” the medical investigator’s postmortem report said.

Baldwin had earlier claimed that he didn’t pull the trigger. “She was standing next to the camera, looking at a monitor … guiding me for how to hold the gun for this angle,” he said. “I pulled the hammer as far back as I could without cocking the gun,” Baldwin added. “I let go of the hammer and bang, the gun goes off.”
