It is actor Alec Baldwin’s lucky day. His infamous ‘Rust’ case has finally been dismissed by the court. The 66-year-old actor was on trial for shooting cinematographer Halyna Hutchins on the set of ‘Rust’ in 2021. The judge gave a very shocking statement and had some grave words for the prosecutor.
Baldwin’s case was dismissed because of the prosecutor’s failure to turn up evidence to the defense. New evidence has come up suddenly in the case. And that is none other than a batch of bullets.
Alec Baldwin’s Case Dismissed By Judge
Before the jury could give their verdict, Judge Mary Marlowe Sommer dismissed actor Alec Baldwin’s manslaughter case. She ruled that no other sanction was sufficient. She also blasted the prosecution for their failure to submit evidence to the defense.
“The state is highly culpable for its failure to provide discovery to the defendant,” Marlowe Sommer said. “Dismissal with prejudice is warranted.” Judge Marlowe Sommer ruled that under the principle of double jeopardy, Baldwin cannot be retried. Marlowe further told the prosecution, “If this conduct does not rise to the level of bad faith, it certainly comes so near to bad faith as to show signs of scorching.”

The Prosecution Is Proud Of Their Efforts
Alec Baldwin’s case dismissal is a big slap on the judicial system. “This was a disaster for the New Mexico judicial system,” said John Day, a lawyer and local legal commentator. “They got a huge allocation of public funds to prosecute this case. And this is what happened with that. This was an absolute catastrophe.” Judge Marlowe agrees with this.
Baldwin’s defense team argued that prosecutors deliberately hid bullets that were turned over to investigators in March, and which are relevant to the case. However, the prosecution was having internal trouble already. Erlinda Johnson, one of two special prosecutors, resigned from the case amid turmoil over the evidence.
Kari Morrissey, the lead prosecutor, said, “I’m disappointed, because I believe that the importance of the evidence was misconstrued by the defense attorneys.” However, they also believe that they have their best. Morrissey continued, “We did everything humanly possible to bring justice to Halyna and to her family, and we’re proud of the work that we did.” Although the prosecution is proud of their work, the accused Alec Baldwin got to walk away happily from the courtroom.
